HUTAMA-RSEA JOINT OPERATIONS, INC. v.
CITRA METRO MANILA TOLLWAYS CORPORATION
G.R. No. 180640, April 24, 2009 (3rd Div., Chico-Nazario, J.)


Both parties are domestic corporations.  The Respondent, Citra Metro Manila Tollways  Corporation  [“Citra”] is the general contractor and operator of the South Metro Manila Skyway Project [the “Project”] The Petitioner, Hutama-RSEA Joint Operations, Inc. [“Hutama”] was its subcontractor.  Citra and Hutama are referred to herein collectively as the “Parties”.  On September 25, 1996, the Parties entered into an Engineering Procurement Construction Contract [the “Contract”] whereby Hutama would undertake the construction of Stage 1 of the Project which stretched from the junction of Buenjdia Avenue, Makati City, up to Bicutan Interchange, Taguig City for a contract price of US$369,510,304.00.

TRUNCATED TRIBUNAL: EFFECT OF DEATH OF TRIBUNAL MEMBER BEFORE AWARD. 


J. King & Sons Company, Inc. v. Construction Industry Arbitration Commission
and Duracon Construction and Development Corporation
CA-G.R. Sp. No. 03358 [Cebu], November 19, 2008


Duracon Construction and Development Corporation [“Duracon”] filed with the Construction Industry Arbitration Commission [“ÇIAC”] a request for arbitration of its claim for payment against J. King & Sons Company, Inc., [“J. King”] arising from a contract for the construction of a warehouse complex.   A panel  of three (3) arbitrators was constituted which thereafter proceeded to hear the case.  After a number of incidents which caused some delay in the proceedings, the case was submitted for decision.  But before the tribunal could issue a final award, one of the arbitrators died.  CIAC directed the parties to inform it  in writing whether they believe it was necessary to fill the vacancy, otherwise the two (2) remaining arbitrators will proceed to render a decision in the case.  J.King failed to respond to this letter. As a result, the two arbitrators rendered an award in favor of Duracon.
