Table of Arbitrator's Fees

(Effective June 2004)

The honoraria of the Arbitrators shall consist of a Base Amount (BA) plus Adjustments to reflect complexity of the case, number of disputants and number of arbitrators.

1.   Base Amount (BA)

a. Up to 1M -   P50,000
b. Over 1M to 5M -   P70,000 + 2% of amount in excess of 1M
c. Over 5M to 10M -   P125,000 + 1% of amount in excess of 5M
d. Over 10M to 20M -   P150,000 + .75% of amount in excess of 10M
e. Over 20M to 50M -   P250,000 + .50% of amount in excess of 20M
f. Over 50M to 100M -   P400,000 + .25% of amount in excess of 50M
g. Over 100M -   P550,000 + .10% of amount in excess of 100M

2.   Adjustments

      The Base Amount computed in Item No. 1 shall be adjusted to take into account the following:

2.1 Complexity (AF1)
Simple 1.0
Complex 2.0
2.2 Number of Disputants (AF2)
2 1.0
3 2.0
4 and over 3.0
2.3 Number of Arbitrator/s (AF3)
1 1.0
3 2.0
2.4 Overall Adjustment Factor (OAF)
OAF                  =   (AF1 + AF2 +AF3) - 3.0           
3. Total Honoraria = (BA x OAF +1.0)



Note:    Total honoraria maybe adjusted by the PDRCI Board upon the Secretariat’s recommendation based on any of the following factors: 1) ability of parties to pay the said fee, 2) complexity of the case and 3) qualifications of arbitrators.  Please note that these fees exclude the administrative fees of the PDRCI and miscellaneous expenses.
