INTERACTION
BETWEEN THE COURTS AND ARBITRAL TRIBUNAL
18 November 2005 - The Philippine Dispute Resolution
Center, Inc. (PDRCI) and The Chartered Institute of Arbitrators East
Asia Branch (CI Arb), in association with USAID and The Asia
Foundation, successfully concluded the seminar “Interaction
Between Courts and Arbitral Tribunals” which was held at the
Discovery Suites, Pasig City, Philippines.
Speakers for
the said seminar included Robin Peard and Anthony Houghton
from CI Arb East Asia Branch and Eduardo Ceniza, Custodio Parlade,
Mario Valderrama and Daisy Arce from PDRCI. The seminar
started with
opening remarks coming from the Chairman of the Regional Subcommittee
of the Chartered Institute of Arbitrators East Asia Branch and the
President of Philippine Dispute Resolution Center, Inc.
Most of the topics discussed during the seminar are new, among them:
the general approach to court involvement in arbitration agreements;
anti-suit injunctions; stay of parallel court proceedings; roles of the
court in establishing the tribunal; court assistance in taking
evidence; extending time limits; questions of law during the reference;
recourse against, and enforcement of, awards. Each session was followed
by a lively question and answer portion which kept the speakers on
their toes. Amb. Sedfrey Ordoñez, Chairman of PDRCI, closed
the proceedings with some witty remarks and observations.
Around 80 participants attended the seminar most of which are lawyers
from the most prominent law firms in Manila and some are department
heads of the biggest companies in Manila engaged in the broadcasting
industry, transportation industry, public utility and construction
industry. The seminar was also attended by respected members
of the judiciary including Justice Regalado E. Maambong, Judge Rowena
M. San Pedro and Judge Eugene Paras who were invited as guests of the
sponsoring organizations as well as some students from different
universities.
